Subject of the Conditions of Participation and Organiser
These terms and conditions govern the conditions for participation in the competition and any necessary transfer of rights. The description and the procedure of the respective competition is carried out within the framework of the respective sweepstake campaign on the Facebook page indicated.
The sweepstake organiser is Bioblo Spielwaren GmbH, Technopark 1 / Obj. C, A-3430 Tulln an der Donau.
By participating in the respective competition these conditions of participation are accepted.
The contest is not affiliated with Facebook and is not sponsored, endorsed or organized by Facebook.
Participation
Eligible to participate in the sweepstake are all persons of full legal age and capacity, who have reached the age of 18 and are resident in Austria. Excluded are employees of the sweepstake organiser and persons commissioned by the organiser. Participation with fake identities or with identities of third parties is not permitted.
Eligible entrants can enter the sweepstake by liking the sweepstake organiser's Facebook page and commenting on the entry.
Participation is possible up to the date stated in the posting.
Prizes and notification of prizes
Among all eligible participants, the specified prize will be drawn without public participation.
The winners will be determined among all eligible participants within one week after the entry deadline. Winners will be notified via FacebookMessenger and asked to send an email to an email address provided there, in which the personal data will be duly and truthfully transmitted. This information will be used to send the prize.
If we do not receive an e-mail from a winner with the winner's personal data (name and address) within the specified period, the claim to the prize expires. In this case, we are entitled to hold a replacement draw.
Only one prize per participant is possible.
The prize is not transferable, nor can the prize be exchanged or paid out in cash.
If circumstances arise for which we are not responsible, the respective winner accepts an appropriate substitute prize. Such circumstances for which we are not responsible are in particular those that lie with the sponsors of the prizes.
Granting of rights of use
The participant grants the sweepstake organizer a transferable right of processing, use and exploitation (in particular also for advertising purposes) of all content (texts, photos, videos, ...) created by him for her and posted on Facebook for participation in the sweepstake, unlimited in time and place. This includes all rights of use of the work and exploitation known to the Copyright Act, including related property rights, as well as the right to assert claims arising from the Copyright Act in court. The sweepstake organizer is in particular entitled to crop, change, delete, archive, store and make technical adjustments to the photos. The participant waives his or her right to be named as the author.
By accepting the prize, the winner agrees that we may use his/her name for advertising purposes.
Liability and indemnification
If the participant uploads photos for the fulfilment of the sweepstake, the participant guarantees that he/she will not send any content the provision, publication or use of which is in violation of applicable law or the rights of third parties.
The participant indemnifies us against claims of any kind by third parties arising from the illegality of photos used by the participant. The obligation to indemnify also includes the obligation to fully indemnify the organizer from legal defense costs (e.g. court and attorney fees).
By participating in the competition, the participant indemnifies Facebook against any liability.
Exclusion
A breach of these conditions of participation entitles us to exclude the respective participant from participation. This applies in particular if the participant provides false information or if the photos used or other content (e.g. comments) are in violation of applicable law or the rights of third parties. The same applies to comments that may be considered to glorify violence, be offensive, harassing or degrading or otherwise go against the social sense of decency.
If the excluded participant is a winner who has already been drawn, the prize can be subsequently revoked.
Comments that violate Facebook guidelines, copyright and Austrian law will be deleted immediately.
Premature termination as well as changes We reserve the right to terminate the sweepstake prematurely in whole or in part at any time, also without adherence to deadlines, or to change it in its course, if it is not possible to guarantee the sweepstake is conducted properly, for technical (e.g. computer virus, manipulation of or errors in software/hardware) or legal reasons (e.g. prohibition by Facebook).
Limitation of liability The lottery organizer is not liable for damages caused by errors, delays or interruptions in data transmission, malfunctions of technical equipment or services, incorrect content, loss or deletion of data and viruses. After the prize has been handed over, the sweepstake organiser does not assume any liability for damages of any kind. Any liability for damages or losses resulting from slight negligence is excluded. Furthermore, the sweepstake organiser shall only be liable in the event of intent and gross negligence.
Data protection Responsible for data processing is the sweepstake organiser, Bioblo Spielwaren GmbH, Technopark 1 / Obj. C, A-3430 Tulln an der Donau, e-mail office@bioblo.com, provided the organiser itself processes the data. We will only use the personal details of the participant and his or her other personal data within the framework of the legal provisions of the data protection law. We will only store, process and use the information to the extent that this is necessary for the carrying out of the sweepstake or if the participant has given his or her consent. This also includes use to exercise the rights of use granted. The data will be used exclusively for conducting the sweepstake and then deleted.
The participant may at any time request disclosure from the sweepstake organizer about the data stored about him or her.
Participants in the sweepstake agree that their personal data, i.e. name, address and e-mail address will be processed by the sweepstake organiser for the purpose of participation in the competition and that name and address of the winner will be forwarded to Österreichische Post AG for the purpose of delivering the prize. This consent can be revoked at any time with the sweepstake organizer.
The legal basis for the processing of the data after registration for the sweepstake by the participant is Art. 6 para. 1 lit. a GDPR if the user has given granted consent.
The data will be deleted as soon as they are no longer required for achieving the purpose of their collection. The user's data will therefore be stored for as long as the sweepstake is active.
We would also like to draw your attention to the following rights to which you are entitled under the GDPR with regard to personal data relating to you: - Right to information from the person responsible for the personal data concerning you in accordance with Article 15 GDPR. - Right of rectification under Article 16 GDPR - Right of deletion under Article 17 GDPR - Right to limit processing under Article 18 GDPR - Right of data portability under Article 20 GDPR - Right to object to processing under Article 21 GDPR
You also have the right to lodge a complaint with the data protection authority if you believe that the processing of personal data concerning you is in breach of the GDPR. In this regard, we also refer you to the homepage of the data protection authority which can be accessed via the link http://www.dsb.gv.at.
Final provisions Should the conditions of participation contain invalid provisions, the validity of the remaining provisions shall remain unaffected. All decisions are final. A cash payment of the prize is expressly excluded. A transfer of the prize is not possible. Austrian law shall apply to these conditions of participation.
